This Guest Release (“Release”) is made by and between The Pleasure Practice, LLC (“Company”) and the guest (“Guest”) regarding Guest’s appearance on the Modern Anarchy Podcast (“Podcast”), produced and distributed by Company.

By checking the box on the form, confirming a recording session, or participating in the recording, I acknowledge that I have read, understood, and voluntarily agree to the following terms:

 

1. Consent to Recording

Guest consents to the audio and video recording of Guest’s appearance on the Podcast (“Interview Recordings”).

2. Ownership & Rights

Guest acknowledges and agrees that Company shall be the sole and exclusive owner of the Interview Recordings and all copyrights therein, including the right to reproduce, edit, distribute, publicly perform, publicly display, publish, monetize, license, excerpt, and create derivative works from the Interview Recordings.

 

3. Intellectual Property

Guest retains ownership of Guest’s pre-existing intellectual property, including Guest’s independently created writings, works, frameworks, materials, and other copyrighted content. Company retains ownership of Company’s independently created intellectual property, including its writings, works, frameworks, materials, educational content, and other copyrighted content. Nothing in this Release transfers ownership of either party’s intellectual property to the other party, except for the rights in the Interview Recordings expressly granted or established by this Release.

To the extent Guest’s pre-existing intellectual property is incorporated into the Interview Recordings, Guest grants Company a non-exclusive, royalty-free, perpetual, worldwide license to use such material as incorporated in the Interview Recordings, including in connection with the reproduction, distribution, publication, promotion, editing, excerpting, archiving, monetization, and creation of derivative works from the Interview Recordings.

This license does not grant Company ownership of Guest’s pre-existing intellectual property or the right to separately reproduce, adapt, sell, or create derivative works from Guest’s pre-existing copyrighted materials independent of the Interview Recordings, except with Guest’s permission or as otherwise permitted by law.

4. Use of Name, Image, Voice, and Likeness

Guest grants Company the right to use, reproduce, display, and distribute the Interview Recordings, as well as Guest’s name, image, voice, likeness, and biographical information, in perpetuity and worldwide for purposes of distributing, broadcasting, publishing, marketing, promoting, archiving, and monetizing the Podcast and Interview Recordings; creating future commentary and derivative works related to the Podcast; and promoting Modern Anarchy and its relationship to The Pleasure Practice, LLC.

Company will not use Guest’s name, image, voice, or likeness in a manner that expressly represents or reasonably implies Guest’s endorsement of any product, service, program, or third-party sponsor without Guest’s prior written consent.

5. Editing, Commentary, and Derivative Works

Guest authorizes Company to edit, excerpt, rearrange, reproduce, or otherwise modify the Interview Recordings and to create derivative works from the Interview Recordings, including promotional clips, compilations, excerpts, educational materials, retrospectives, and future commentary.

Guest acknowledges that Company retains editorial control over the Interview Recordings and related works and that Guest has no right of prior review or approval over Company’s editing, publication, promotion, commentary, or other authorized uses of the Interview Recordings, except as otherwise expressly agreed in writing.

6. Guest-Provided and Third-Party Content

If Guest provides or incorporates copyrighted materials into the Interview Recordings, Guest represents that Guest owns such materials or has the necessary rights or permissions to authorize their use as contemplated by this Release. To the extent such materials constitute Guest’s pre-existing intellectual property, the license set forth in Section 3 applies.

 

7. No Endorsement of Guest Views

Guest understands that participation in the Podcast does not constitute Company’s endorsement of Guest’s opinions, statements, views, products, services, organizations, or other activities. Views expressed by Guest are Guest’s own and do not necessarily reflect the views of Modern Anarchy, The Pleasure Practice, LLC, or its representatives.

8. No Compensation

Guest understands that Guest will receive no monetary compensation, royalties, residuals, or other payments for Guest’s participation in the Podcast or Company’s authorized use of the Interview Recordings, unless otherwise agreed in writing.

9. Publication and Continued Use

Guest understands and agrees that Company is not obligated to publish or distribute the Interview Recordings and may determine whether, when, where, and how to publish or distribute them at its sole discretion.

​

Guest further understands that the rights and permissions granted to Company under this Release are intended to allow Company to continue using and distributing the Interview Recordings and authorized derivative works on an ongoing basis. Accordingly, to the fullest extent permitted by law, Guest may not revoke the rights granted under this Release or require Company to remove, delete, unpublish, or cease distribution of the Interview Recordings or authorized derivative works, except as otherwise agreed to by Company in writing or required by law.

10. Release of Claims

To the fullest extent permitted by law, Guest releases, waives, and discharges Company, its employees, agents, contractors, and affiliates from claims, demands, liabilities, and causes of action arising from or related to Guest’s appearance on the Podcast or Company’s authorized use of the Interview Recordings or Guest’s name, image, voice, or likeness under this Release.

11. Governing Law
This Release shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-laws principles.

12. Agreement

By checking the box on the form, confirming a recording session, or participating in the recording, Guest acknowledges that Guest has read and understood this Guest Release and voluntarily agrees to its terms. Guest understands that this Release constitutes a legally binding agreement between Guest and The Pleasure Practice, LLC.
